Attention: Beginning June 12, 2023, in accordance with section 381.986(6)(b)6., Florida Statutes, and the Department of Health’s Emergency Rule 64ER23-2, all NON-CLOSE RELATIVES applying for a caregiver Medical Marijuana Use Registry (MMUR) identification card must complete a level 2 background screening, pursuant to section 381.986(9), Florida Statutes, through a Livescan Service Provider.

 

Section 381.986(1)(c), Florida Statutes, defines a “close relative” as “a spouse, parent, sibling, grandparent, child, or grandchild, whether related by whole or half blood, by marriage, or by adoption.”

 

Current caregivers will be grandfathered in until the time of their next renewal.

Attention: The Florida Department of Highway Safety and Motor Vehicles (HSMV) will be updating their photo and residency services on Sunday, April 10, 2022, from 7:00 AM – 12:00 PM (EST). During this time, HSMV photos and residency will be unavailable for patients and caregivers who are submitting their initial or renewal applications.

Applicants may either wait for this maintenance to be completed, or they may supply their own, "passport-style" photograph in accordance with 381.986 (7)(a)2., Florida Statutes or supply their own proof of residence documentation in accordance with 381.986 (5).(b)., Florida Statutes.

Please note, supplying your own photo may increase the application's approval processing time up to 10 business days.


Attention Physicians: On October 5, 2022, the Florida Department of Health issued Emergency Order 22-005, which, in part, temporarily suspends the in-person physical examination requirement set forth under section 381.986(4)(a)1., Florida Statutes (F.S.), for recertification examinations of existing qualified patients. Under Emergency Order 22-005, qualified physicians may use telehealth, as defined by section 456.47(1)(a), F.S., for recertification examinations of existing qualified patients in Charlotte, Collier, DeSoto, Flagler, Hardee, Hendry, Highlands, Hillsborough, Lake, Lee, Manatee, Orange, Osceola, Pinellas, Polk, Putnam, St. Johns, Sarasota, Seminole, and Volusia Counties until November 30, 2022.

Emergency Order 22-005 does not supersede or exempt a qualified physician from meeting all other minimum practice requirements and standards of care, including obtaining the voluntary and informed written consent of the patient.

Attention: Pursuant to section 381.986(4)(f), Florida Statutes (F.S.), the Medical Marijuana Use Registry (“Registry”) was updated on August 29, 2022, to implement Emergency Rule 64ER22-8, Dosing and Supply Limits for Medical Marijuana. This emergency rule determines the daily dose amounts and supply limits for approved routes of administration of marijuana (excluding low-THC cannabis).

Section 381.986(4)(f)1., F.S.allows a qualified physician to request an exception to the daily dose amount for their qualified patient by electronically submitting the “Request for Exception” form in the Registry.

Patients must contact their qualified physician to inquire about the Request for Exception process. Certifications created before August 29, 2022, will not require a “Request for Exception” form, unless the physician alters the original order(s).

Attention: All patients will be given a 35-day transitionary period from March 1, 2022, to April 4, 2022. During this time, only dispensations made on or after March 1, 2022, for marijuana in a form for smoking, will be used to calculate the amount available to be dispensed to the patient.

Beginning April 5, 2022, all patients will be on their own 35-day rolling limit based on their previous dispensations during the transitionary period, and per section 381.986(8)(e)16.b., Florida Statutes, MMTCs will not be permitted to dispense an amount in excess of a patient's 35-day rolling limit.

To help patients/caregivers and MMTC employees know how many ounces a patient is eligible to receive, the Registry will be updated with a new "Amount Available Calculation" dashboard.

Upcoming Maintenance: Please The Medical Marijuana Use Registry ("Registry") will be undergoing an extended maintenance period beginning June 24, 2022, at 10 PM (ET) and ending (anticipated) June 25, 2022, at 10 AM. During this time, the Registry will be unavailable to ALL Registry users.

 


Attention Physicians & MMTC's: 
Beginning September 1, 2021, MMTC's must dispense Delivery Devices to qualified patients in the Registry per 381.986 (5)(a), Florida Statutes. Furthermore, for certifications/orders created on or after September 1, 2021, when a physician wants to recommend a patient to use delivery devices to administer their orders, the physician must authorize a delivery device for each route they recommend patients to use.
